Tata Sons Private Limited (“Tata Sons” or “we”) take the privacy of your information seriously. This privacy statement explains what personal data we collect from you on the Career Opportunity Portal (specifically on the application hosted by ‘TurboHire’) and Tata World (the “Application” or “Portal”) for career opportunities recruitment process and how we use that data.

This privacy statement applies to the Portal and sub-links and sub-domains contained thereunder.

Definitions

1. In this privacy statement, the following definitions are used:

Application or Portal

the application that you are currently using, to apply for roles with various Tata Group companies that post their requirements on the Career Opportunities Portal and also includes Tata World;

Cookies

A small file placed on your computer by the Application when you either visit or use certain features of the Application. A cookie generally allows the website to “remember” your actions or preference for a certain period.

Data

is the personal data submitted on the Portal which may include Sensitive Personal Information;

Data Protection Laws

any applicable law relating to the processing of Data;

2. Scope

a. You provide some of Data directly, such as when you register on the Portal or apply for a job vacancy on the Portal. No Sensitive Personal Information is collected without your consent, apart from any information or Data voluntarily submitted by you. Such voluntary information/Data shared by you shall deemed to be consented to be shared within the Portal. 

b. When you are asked to provide Data, you may choose not to provide the information. However, if you do not provide the personal data which is mandatory to register you in the Portal, then your registration will be incomplete, and you may not be able to access any sections of the Portal or if you do not provide the Data needed for a job vacancy, you would not be able to apply for that particular job vacancy.

c. By registering on the Portal or applying for a job vacancy on the Portal and submitting your Data, you expressly consent to Tata Sons, the relevant Tata Group companies involved in the recruitment process, and authorised service providers engaged by them, collecting, storing, processing, using, transferring and disclosing such information for the purposes set out in this Privacy Statement. 

d. Consent may be withdrawn at any time by submitting a request to the contact details provided below, subject to the consequence that certain services or functionalities of the Portal may no longer be available. In the process of collecting the Data, we have no liability or commercial interest in the same.

3. Data Collected

We may collect Data that could allow you to be identified, including:

a. Contact information: We collect your first name, last name, contact details, address, qualification details, emergency contact (name and number), date of birth, gender,;

b. Nationality;

c. CTC details;

d. Educational background, certifications, previous employment details;

e. Tata Group company job details, performance details and employment history; and

f. Cookies, IP address and geo-location: These details are usually captured by the browser automatically when you visit the Portal.

4. How we Collect Data

We collect your Data in the following ways:

a. data is given to us by you when you register on the Portal or apply for a job vacancy; 

b. data collected when you contact us through the Portal;

c. data collected when you subsequently edit the Data for your profile; 

d. when you elect to receive any communications (including any newsletter, promotional offers) from us;

e. data collected through Cookies;

5. Data that is Collected Automatically

a. We automatically collect some information about your visit to the Portal via Cookies in line with the cookie settings on your browser. For more information about Cookies, please see the section below, titled “Cookies”.

This information helps us to make improvements to our Application content and navigation and includes your IP address and the way you use and interact with its content.

b. Our web servers or affiliates who provide analytics and performance enhancement services collect IP address, operating system details, browsing details, device details and language settings. This information is aggregated to measure the number of visits, average time spent on the site, pages viewed and similar information. We use this information to measure the site usage, improve content and to ensure safety and security, as well enhance performance of the Application.

c. The Portal may use automated business rules to assess eligibility criteria established by Tata Sons or the relevant Tata Group Company, such as minimum tenure requirements. No solely automated decision producing legal or similarly significant effects on an applicant shall be made without meaningful human review

6. Our Use of Data

Specifically, Data may be used by us for recruitment and employment purposes, including:

a. Identifying and evaluating candidates for open positions at various Tata Group companies;

b. maintaining appropriate record-keeping related to hiring practices;

c. analysing the hiring process and outcomes;

d. fulfilment of legal obligations in connection with such recruitment and employment; and

e. conducting background investigations, as permitted under applicable law (the “Purposes”).

We may use your Data for the above purposes if we deem it necessary to do so for our legitimate interests. If you are not satisfied with this, you have the right to object in certain circumstances (see the section headed "Your rights" below).

7. Who we share Data With

We may share your personal Data with:

a. Tata Sons controlled affiliates and subsidiaries and other entities within the Tata group of companies, to assist them to reach out to you in relation to their programs or campaigns (including marketing and sales) and to process your query / requests (such as job application). Any such transfer shall only be undertaken where the recipient ensures the same level of data protection as is required under applicable law and where such transfer is necessary for the performance of the recruitment process or has otherwise been consented to by you;

b. our employees and professional advisors working on our behalf for the Purposes; and

c. Service providers who assist in protecting and securing our systems and provide services to us which require the processing of personal data, such as to host your information or to process your information for data profiling and user analysis.

We usually do not share personal Data collected from the Application with other third parties. However, this may happen if:

(a) You request or authorize us to do so;

(b) We need to comply with applicable law or respond to valid legal process; or

(c) We need to operate and maintain the security of this Application, including preventing or stopping an attack on our computer systems or networks.

8. Your data accessed by other users of the Application

Your Data will be accessed and processed by individuals who are involved in the hiring process on the Career Opportunities Portal, Tata Sons and where relevant, other Tata Group companies.

9. Keeping Data Secure

We are committed to protecting the security of your Data. We use a variety of security technologies and procedures to help protect your Data from unauthorized access, use or disclosure. We use technical and organisational measures to safeguard your Data and we take full caution from our end to store your Data on secure servers. Technical and organisational measures include measures to deal with any suspected data breach. If you suspect any misuse or loss or unauthorised access to your Data, please let us know immediately by contacting us via e-mail on careeropportunities@tata.com. 

10. Retention of Personal Data

Tata Sons retains personal Data for as long as necessary to provide the access to and use of the Application, or for other essential purposes such as complying with our legal obligations, resolving disputes and enforcing our agreements. Because these, needs can vary for different data types and purposes, actual retention periods can vary significantly.

Even if we delete/remove/de-activate your personal Data, it may persist on backup or archival media for audit, legal, tax or regulatory purposes.

11. Your Rights

When we process Data about you, we do so with your one-time consent and/or as necessary to provide the Application you use, meet our contractual and legal obligations, protect the security of our systems or fulfil other legitimate interests of Tata Sons as described in this privacy statement.

Tata Sons adheres to applicable data protection laws including the following rights in relation to your Data:

a. Right to access - the right to request copies of the Data we hold about you at any time;

b. Right to correct - the right to have your Data rectified if it is inaccurate or incomplete;

c. Right to erase - the right to request that we delete or remove your Data from our systems. 

d. Right to restrict our use of your personal Data - the right to limit the way in which we can use your Data. 

e. Right to data portability - the right to request that we move, copy or transfer your Data.

f. Right to withdraw consent - Where processing is based on consent, you may withdraw your consent at any time without affecting the lawfulness of processing undertaken before such withdrawal.

g. Right not to be subject to automated decision-making- You have the right not to be subject to a decision based solely on automated processing, including profiling, where such decision produces legal or similarly significant effects concerning you.

h. Right to object - the right to object to our use/process of your Data. For information about managing your contact data, email subscriptions and promotional communications, please submit a request to us at careeropportunities@tata.com. We will use reasonable efforts to ensure that your Data is maintained and up to date. However, you are under a duty to inform us of any and all changes to your Data to ensure that it is up to date and we will update or delete your Data accordingly.

If we provide you with access to the information we hold about you, we will not charge you for this, unless your request is manifestly unfounded or excessive. We reserve the right to refuse any such request without providing an explanation.

12. Links to other websites

This Application may, from time to time, provide links to other websites. We have no control over such websites and are not responsible for the content of these websites. This privacy statement does not extend to your use of such websites.

13. Cookies

This Application may place and access certain Cookies on your device. We use Cookies to improve your experience of using the Application.

You can choose to enable or disable Cookies in your internet browser. By default, most internet browsers accept Cookies, but this can be changed. For further details, please consult the help menu in your internet browser.

You can choose to delete Cookies at any time; however, you may lose any information that enables you to access the Application more quickly and efficiently including, but not limited to, personalisation settings.

It is recommended that you ensure that your internet browser is up-to-date and that you consult the help and guidance provided by the developer of your internet browser if you are unsure about adjusting your privacy settings.

14. Severability

If any court or competent authority finds that any particular provision of this privacy statement (or part of any provision) is invalid, illegal or unenforceable, that provision or part-provision will, to the extent required, be deemed to be deleted. The validity and enforceability of the other provisions of this privacy statement will not be affected.

15. Changes to this Privacy Statement

Tata Sons reserves the right to change this privacy statement as it may deem necessary from time to time or as may be required by law. Any changes will be immediately posted on the Application and you are deemed to have accepted the terms of the privacy statement on your first use of the Application following the alterations.
